Bankruptcy Judge Herbert A. Ross ruled January 13, 1999 that the bankruptcy trustee could not recover from BRA Defendants under a theory of usury. Some of the BRA Defendants had already had default judgments entered against them on grounds that included usury. This decision addresses those default judgments.

ORDER GIVING NOTICE OF INTENT TO SET ASIDE DEFAULT JUDGMENTS WITH RESPECT TO USURY |
Pursuant to a memorandum decision(1) being entered concurrently,
IT IS ORDERED that,
1. NOTICE OF INTENT TO SET ASIDE USURY DAMAGES AWARDED IN DEFAULT JUDGMENTS- The court gives notice of its intent to set aside the default judgments, but not the defaults, of those judgment creditors listed in the table attached to the Memorandum Regarding the Setting Aside of Default Judgments With Respect to Usury, dated February 23, 1999.
2. TIME FOR TRUSTEE TO RESPOND- The trustee must file an opposition to the court setting aside the usury damages by Friday, March 19, 1999, or the court will proceed to set the usury damages aside. If an objection is filed, the defendants affected may file a reply in support of setting aside the usury damages.
3. IF THE TRUSTEE DOES NOT OBJECT- If the trustee does not choose to challenge the legal basis of the court's intent to set aside the default judgments, he should provide to the court a recalculation of damages for each of the adversary cases. At least a three-day notice of any intent to enter a modified default judgment must be given.(2)
