One of a Chapter 7 Bankruptcy Trustee's duties is to review and analyze proofs of claim filed by creditors in the bankruptcy case. If there are legal grounds for challenging the claim or the amount sought by the claimant, the trustee is required to object to the claim.
The trustee has begun that review process and asked the bankruptcy judge to disallow portions of claims filed by those persons who received recoverable monies from the debtor, but who were not sued as BRA Defendants (usually because they received only a very small amount of monies). Under the Bankruptcy Code, a creditor cannot retain a recoverable benefit and successfully assert a claim against the estate.
The following creditors, all of whom are in Fairbanks, had their claims disallowed. The first column shows the proof of claim number, the second the claimant's name(s), the third the amount sought by the proof of claim, the fourth the docket entry number, the fifth any duplicate docket entry, and the last column the amount of money the creditor was proven to have received.
