This is to correct several typographical errors that appeared in the Memorandum Decision Determining That the Trustee Has Established That Debtors Operated a Ponzi Scheme From 1989.
They are:
Page 29, Line 5, under the title Failure to Include Wasilla Records, the Memorandum states: "Secondly, even if Wasilla had been missed, there is no indication that tickets were purchased out of the Wasilla location, and MacPhee has accounted for all frequent flyer miles purchased from brokers and used that figure to arrive at a gross sales figure." (Italics added). Instead of the word "tickets," the words "frequent flyer miles" should be inserted. The intention of the sentence is to state that, per the trustee, the debtors did not purchase frequent flyer miles from brokers through the Wasilla office.
Page 39, Line 8, I indicate that the Frye case had been "succeeded by the legislatively adopted Rules of Civil Procedure, and in particular, FRE 702." (Italics added). The intended reference was the Federal Rules of Evidence, not the Rules of Civil Procedure.
